Terms of Use

Applies to the drovee iPhone app.

This text is an agreement between you and Martin Krček, a private individual based in the Czech Republic, email martin@krcek.cz (“we”). By installing and using the app you accept it. We tried to write it so it can be read start to finish.

1. What drovee is

drovee is a personal drive journal. It records a drive, works out the approximate distance and time, awards XP and sometimes a trophy, and asks how it went. It nudges you to try different situations — night, rain, a motorway, parking — instead of the same familiar route over and over.

That's all it is. The rest of this section is about what drovee isn't, because that's where people most often get it wrong.

2. What drovee is not

It is not a driving school or driver training. drovee does not teach driving, runs no lessons, has no instructor and issues no certificate, confirmation or proof of practice. Nothing you collect in the app has any official or educational standing. You learn to drive with a driving school and with the person sitting next to you — not with a phone.

It is not an official app of the Czech Ministry of Transport or of any other authority. It has no connection to them, no one approves it, and nothing is reported from it anywhere.

It is not an official record of journeys or a logbook. Records in drovee are not evidence for an authority, an insurer, an employer, a driving school or a tax office. If you need to log journeys officially, keep that record where it is required of you.

It does not rate how you drive. The app calculates no driving-quality score, knows nothing about speed, and infers nothing about whether you're a good or a bad driver. The Experience Level counts experiences; it is not a grade.

It does not make anyone a safe or finished driver. Using the app will not by itself improve your driving or reduce any risk on the road. drovee only writes down the experiences you bring back with you.

3. The drive is your responsibility

This is the most important paragraph in the document.

  • The driver is always responsible for the safety of the drive and for obeying the rules of the road. The app changes nothing about that and we take on none of it.
  • drovee never pushes you. There are no daily streaks, no leaderboards, no reward for longer or faster drives, and it will never say “go for one more”. When it suggests something to try next time, it's an offer for some day — not a task for today.
  • The app asks nothing of you while you drive. You tap Start Drive before setting off, and the phone can stay locked in your pocket. XP, trophies and questions all come after you stop. Nothing in the app is meant to be operated while driving. If you need to change something, stop and park first.
  • Judge every suggestion yourself. “Try it when it rains” only holds if you feel up to it and conditions are safe. If you're unsure, don't drive — no amount of XP is worth a risk, and you lose nothing in drovee by waiting.
  • If you drive under an accompanied-driving scheme, everything the law prescribes for it applies on top of this. The app neither monitors nor enforces it.

4. The numbers are approximate

Distances and times in drovee are a GPS estimate, not a measurement. The app admits this in the way it writes them: ~45 km, not 45.3 km. The real figure may differ — signal drops in a tunnel, a garage or a dense city, and part of the route is missing.

One thing follows, and it matters: figures from drovee are not intended for official, accounting, tax or employment use. Don't use them as the basis for travel expenses, a logbook, an invoice, or as evidence of anything. You can correct the distance by hand after a drive, but even a corrected number doesn't turn the entry into a document.

The weather shown with a drive comes from Apple Weather and is likewise indicative.

5. Your data is yours

Drives, XP and trophies live on your phone. We have no access to them and we hold no backup of them. The details are in the Privacy Policy.

In practice: if you lose your phone or delete the app, the data is gone and we have nowhere to restore it from. If it matters to you, turn on backup to your own iCloud in your Profile. We are not liable for lost data — we can't be, we don't have it.

6. How you may use the app

We grant you the app for ordinary personal use on devices that belong to you. This is not a sale — the software stays ours, including the name, logo, texts and graphics.

You may not sell or rent the app, pass it or parts of it off as your own, circumvent its technical limitations, or use it to interfere with anyone else's devices. Reverse engineering is prohibited to the extent the law allows.

The app is distributed through the App Store, so Apple's rules for downloading apps apply as well. Where those rules conflict with this text, Apple's rules govern your relationship with Apple; your relationship with us is governed by this text.

7. Limitation of liability

The app is provided as is. We work to keep it functioning and truthful, but we don't promise it will be continuously available, free of bugs, compatible with every device and system, or that every drive will be recorded completely and accurately.

To the extent permitted by law, we are not liable for damage arising from using the app or from relying on its data — in particular for inaccurate distances, a drive that wasn't recorded or was lost, a notification that didn't arrive, a drained battery, mobile data used, or decisions you make on the road on the basis of the app.

We do not limit liability where the law does not allow it — in particular for damage caused intentionally or by gross negligence, and for personal injury. If you are a consumer, nothing in this text takes away any right the law gives you.

8. Changes and termination

We keep developing the app — features may be added, changed or removed. We may therefore update these terms; the last-updated date is at the top and any substantial change will be announced in the app. If you don't agree with a new version, delete the app — that is how you end this agreement.

We may also stop developing the app or withdraw it from the App Store. Data already on your phone doesn't disappear because of that.

9. Governing law and disputes

This relationship is governed by the law of the Czech Republic. If you are a consumer, this does not deprive you of the protection afforded by the law of your country of residence.

If a dispute arises, write to martin@krcek.cz first. Most things are settled by email. As a consumer you may also turn to the Czech Trade Inspection Authority (www.coi.cz) with a proposal for out-of-court settlement.
